New European Competition Trends in Digital Markets
Descargas: 502
Digital Platforms have emerged as key players in today’s economy, but their market performance has raised various competition concerns. In response, Competition Authorities in the United States and the European Union have developed tools and conducted proceedings in recent years to address these issues. This book examines these developments in depth.
New enforcement mechanisms, such as those introduced in Germany's GWB Novelle (paragraphs 19a and 32f GWB), stand out as significant innovations in competition law. In the realm of mergers, digital platforms present unique challenges, particularly regarding theories of harm and the commitments required to resolve competitive concerns. These topics demand detailed analysis.
In terms of abuse of dominance, the impact on AI innovation and the need for a balanced regulatory approach are critical issues. Moreover, the interaction between digital platforms and data usage is especially important, highlighting the intersection of enforcement elements from both competition and data regulation.
This book compiles papers presented at the III Valencia International Meeting on Competition Law, held under the framework of two research projects: «Concentración, Daños, Abuso y Cooperación en los Mercados Digitales» (PID2021-128111OB-I00), funded by the Ministerio de Ciencia e Innovación, and «Competition Power Control» (CIAICO/2021/202), supported by the Generalitat Valenciana. We trust this volume will be a valuable resource for professionals and scholars in the field.
